The Islamabad High Court (IHC) on Wednesday dismissed a petition challenging the appointment of former Justice Sardar Mohammad Raza Khan as Chief Election Commissioner. A single-member bench headed by Justice Athar Minallah heard the petition filed by Shahid Orakzai, seeking disqualification of Sardar Mohammad Raza Khan.
The court ruled that the petitioner was not an aggrieved party rather he was attempting to make the appointment controversial. The court dismissed the petition and ordered Orakzai to pay Rs 20,000 as fine for wasting 20 minutes of the court. The petitioner submitted that constitutional requirements were not fulfilled in appointment of CEC, pleading the court to issue stay order against the appointment. He stated that neither Prime Minister Nawaz Sharif appointed the CEC as prescribed in the constitution, nor the parliamentary committee interviewed him before appointment.
