The Islamabad High Court (IHC) rejected an intra-court appeal against the establishment of a special court for the conduct of a treason trial of former president General Pervez Musharraf (Retd). A division bench of the IHC comprising Chief Justice Anwar Kasi and Justice Shaukat Siddiqui, while hearing an intra-court plea filed by Riaz Hanif Rahi advocate rejected the petition, up-holding the objections raised by the Registrar Office.
Riaz Hanif Rahi filed a petition, praying that the constitution of the special court was against the law and constitution. He requested the court to cancel the notification regarding the establishment of the special court for Musharraf's treason trial. The bench upheld the objections raised by the Registrar's Office and rejected the intra-court appeal filed against the special court. The Registrar's Office had maintained that the petitioner was not an aggrieved person in Musharraf's treason trial, and the special court could be challenged in the Supreme Court of Pakistan.
The bench further said the decision to hold Musharraf's trial was taken by the government and that the person on trial had himself not objected the move. The Supreme Court (SC) had constituted a three-member special court headed by Justice Faisal Arab comprising Justice Tahira Safdar and Justice Yawar Ali last month in response to a federal government's request, for trying Musharraf under Article 6 of the constitution. On December 13, the special court held its first meeting in the Federal Shariat Court to examine the complaint filed by the federal government against Musharraf and issued summons to him to appear before it on December 24.
