The presidential candidate, former Justice Wajihuddin Ahmad, is filing a petition in the Supreme Court on Monday (today) for the postponement of October 6 polling till the decision of the apex court on the candidature of General Musharraf.
Senior panellists of Wajihuddin lawyers told Business Recorder here on Sunday that they were also challenging candidature of General Musharraf under Article 25 of the Constitution as an aggrieved party. Article 25 says: "all citizens are equal before law, and are entitled to equal protection of law."
Supreme Court Bar Association (SCBA) President Munir A. Malik and another panellist Tariq Mahmood said the civilian presidential candidates were at a disadvantageous position as compared to their rival, General Pervez Musharraf.
They said the Chief Election Commissioner (CEC) had not yet provided them a copy of his written order to overrule the objections raised by the civilian presidential candidates against the candidature of General Musharraf.
CEC former Justice Qazi Farooq Ahmad on Saturday accepted nomination papers of President Musharraf and allowed him to contest the election while retaining the office of the Chief of Army Staff (COAS).
Wajihuddin's lawyers said after getting a certified copy of the CEC judgement at 9 am on Monday, they would file the petition in the Supreme Court with a request for an early hearing and a stay order for the postponement of the presidential election.
PPP candidate Amin Fahim has also announced to challenge General Musharraf's candidature in uniform. Sources in the PPP said that Senator Latif Khosa and Advocate Farooq Naik would file the petition in the Supreme Court on Monday.
