imageISLAMABAD: The Supreme Court on Tuesday dismissed election petition filed against Member Khyber Pakhtunkhwa Provincial Assembly, Hussain Shah over alleged allegations of rigging in the 2013 general election.

The three-member bench of the apex court headed by Justice Saqib Nisar comprising Justice Sh. Azmat Saeed and Justice Mushir Alam heard the petition filed by Zubair Shah against Election Tribunal decision.

Hussain Shah had got 8382 votes in general election from PK-60 Batagram on a Jamiat Ulma-e-Islam (Fazal) ticket and independent candidate Zubair Shah got 7954 votes.

During hearing of the case, Justice Saqib remarked that the ET could not order recounting and verification of votes by NADRA on each application.

He remarked that the court could not null and void result of any constituency without solid evidence.

The court dismissed Zubair Shah petition over lack of evidence and maintained the verdict of ET.

The petitioner filed the petition before the Election Tribunal (ET) seeking disqualification of Hussain Shah over allegations of rigging in the general election.

The petitioner also sought recounting and verification of votes through thumb impression from National Database and Registration Authority (NADRA).

The ET rejected Zubair's appeal over lack of evidence.
