imageISLAMABAD: The Supreme Court (SC) Wednesday reserved its verdict on former Chief Justice of Pakistan (CJP) Abdul Hameed Dogar plea to annul Special Court order regarding fresh investigation in High Treason case against aiders and abettors.

The three-member bench of the court headed by Justice Asif Saeed Khan Khosa and comprising Justice Sardar Tariq Masood and Justice Tariq Pervez heard the petition filed by former CJP Abdul Hameed Dogar challenging IHC refusal to hear his plea against the verdict of Special Court in the high treason case.

Justice Asif Khosa remarked that the court would review that whether the Islamabad High Court or Special Court had the authority to re-issue order regarding investigation of the treason case. There was no article in the Constitution to stop trial, he added.

During course of proceedings, Barrister Faroogh Naseem counsel for former President Pervez Musharraf told that the Federal Government had stated before the IHC that it was ready for fresh investigation in the High Treason case.

If the federal government was ready for fresh investigation then respondents claim that the court had no authority to re-issue orders regarding investigation was baseless.

He sated that if the former CJP was not agreeing for re-investigation in the case then why he gave consent before the court.

The Attorney General told the court that it was federal government authority to include name of an accused for investigation.

Justice Asif Saeed remarked that Musharraf's counsel stated in the court that the former president imposed emergency in the country as Chief of Army Staff. On this, Faroogh Naseem replied that the same lawyer contradicted the statement in a press conference.
