ISLAMABAD: The Supreme Court on Thursday dismissed an application filed against the appointment of Chairman National Database and Registration Authority (NADRA) terming it 'not maintainable'.
A three-judge bench headed by Chief Justice Tassaduq Hussain Jillani and comprising of Justice Amir Hani Muslim and Justice Ejaz Afzal Khan heard the case.
During the course of proceeding, the Bench remarked that the petition filed by Ali Raza Kazim was not maintainable as it was filed under Article 184 (3) of the Constitution which relates to the fundamental rights.
The Bench maintained that under no circumstances the appointment of Tariq Malik as the Chairman NADRA falls in the violation of fundamental rights.
Chief Justice Tassaduq Jillani remarked that the matter does not pertain to the said Article pertaining to fundamental rights.
However, the Court suggested that the petitioner could re-file amended petition stating more durable grounds in his application and thus the petition was dismissed.
It is pertinent to mention here that Ali Raza Kazim filed this petition against the appointment of Tariq Malik on the post of Chairman NADRA, terming it illegal and infringing the fundamental rights way back however the apex court took up the petition on Thursday and dismissed it accordingly.
