ISLAMABAD: Sindh High Court (SHC) has dismissed petitions filed against imposition of tax on immovable properties on “deemed income basis” under section 7E of Income Tax Ordinance, 2001.

The hearing of cases dealing with section 7E was concluded at SHC. The court dismissed the petitions through a short order and the reasons will be recorded later on by the court through a detailed judgment.

The petitioners have questioned the constitutionality of Section 7E – the tax on deemed income of the Income Tax Ordinance, 2001, inserted through the Finance Act, 2022, on the premise of legislative incompetence of the Parliament to enact law outside the scope of Entry 50 of the Federal Legislative List, Fourth Schedule of the 1973 constitution.

The federal government has levied income tax on deemed income through section 7-E of the Income Tax Ordinance, 2001.

Its a mile stone decision by the SHC, because there is strictly prohibited by in Islam on ZAKHRAANDOZI, to hold much more properties is actually the criminal thought of the investor to make black money. Pakistan actually facing financial crises and have no such money in hand to run day to day affairs of the country and always giving blew to IMF for loan on heavy conditions and markup and in other side the people of the country are holding money through investment in properties. I say remain dear sir and shabash to SHC.

@Fida, I am absolutely astonished to see the stupidity and idiocy behind your comment. Apart from the incorrect and laughable English you have used, it is base less and stupid. Investing in a property is not "zakhira andozi" and it has nothing to do with any holding of money. All this is done by the federal government in order to get loans from the IMF due to their incompetence and have pressurised the courts to get this shameless decision. And people like you are the actual reasons we are in this state of political atrocity.

@kashif, thanks for your kind comments, you know better that the government allows housing schemes only if it increases public welfare or business, but nothing else. It is not that if an individual buys a hundred plots, his original purpose is lost. Those who practice this practice only aim to make black into white or remit it at higher prices in the future. Plots of housing schemes come under the definition of stock. Hoarding is just Zakjira andozi, what else is there?
