Sindh High Court was told on Friday that board of directors of Oil & Gas Development Corporation in its resolution passed on April 28, 2008 resolved to set up LPG Extraction Plants in accordance with government of Pakistan LPG production and distribution policy 2006, as amended on February 25, 2008 by Economic Coordination Committee of the Cabinet and will withdraw expression of interest for installation of LPG extraction plants on build, own and operate (BOO) basis.
Submitting written statement before SHC's division bench, on behalf of petitioners Abdul Wahid and Zafar Mahmood Malik, who are also shareholders of OGDC, senior advocate Abdul Hafeez Pirzada, said petition filed against plan of OGDC to outsource LPG extraction from OGDC's gas fields to private sector on BOO basis has borne fruits and prayed court to dispose of petition.
The division bench comprising Justice Azizullah Memon and Justice Child Ali Z Kazoo allowed request of petitioners and disposed of the matter. Petitioners had moved SHC against plan of OGDC to privatise its liquefied petroleum gas extraction business.
They claimed Mineral oil and natural gas' are included in Part-II of Federal Legislative List, fall within the purview of Council of Common Interests and CCI's powers in respect of subjects contained in Federal Legislative List's Part-II have been elaborated in Supreme Court judgement in Pakistan Steel case and stated transfer of LPG rights would cause substantial loss to Corporation's shareholders. They had prayed to restrain OGDC from outsourcing LPG extraction from OGDC's gas fields to private sector on BOT basis.
