LAHORE: A Lahore High Court (LHC) division bench on Tuesday allowed Pakistan Tehreek-e-Insaf (PTI) candidate Nasir Cheema to contest election from PP-53 (Gujranawala), who was disqualified by Election Commission of Pakistan (ECP) for using the photos two heads of institutions on his posters.

The bench comprising Justice Amin-ud-Din Khan and Justice Muhammad Sajid Mehmood Sethi passed the orders while allowing a petition filed by Nasir Cheema challenging decision of the ECP.

During the hearing, petitioner's counsel arguing before the bench submitted that his client was declared ineligible by the ECP for violating code of conduct on using photos of two heads of institutions on his posters.

He submitted that the candidate did not violate any code of conduct as ECP issued code of conduct on June 14, 2018 whereas the posters in question were put up in April and were not part of the his client's electoral campaign.

He said that no complaint had been filed against the petitioner before the commission and pleaded that the impugned decision by the ECP had not referred to any law invoked for his disqualification.

He pleaded with the court to set aside the ECP decision and allow his client to contest election from PP-53 after accepting his nomination papers.

However, ECP's counsel opposed the plea saying that the petitioner was disqualified for sheer violation of the electoral code of conduct. He said that the ECP lawfully exercised its powers by handing down the impugned decision.

The court after hearing arguments of the parties allowed petitioner to contest the election.
