There is a high frequency of spurious products flooding the market, some of which belong to product categories that are capable of serving as major hazards to consumers' health. One such category is the pharmaceutical or drug industry. Cited are occasional instances when trademark infringement, labelling is often seen to display the generic names of substances making the product, available in equal prominence as that of the brand name.
Such infringement also exists in other product categories. The result is that it dilutes the minds of the consumers and implies total interchangeability and equality among different products with regard to quality, efficacy, and safety.
It is important to note that such instances place Pakistan in violation of the WTO TRIPS rules protecting trademarks. The law enforcement agencies must check such violations.
