The NWFP Senior Minister Sirajul Haq has said Hasba Bill was basically aimed to provide relief to the poor and oppressed segments of the society. He told this during an interview with the American Cable News Agency Associated Press Television Network (APTN) Senior Producer for South Asia Andrew Drake at his office Peshawar.
Sirajul Haq claimed the Bill was also aimed to effectively check misuse of power, ensure supremacy of law and merit, eliminate social evils including crimes and restore basic human rights usurped by the influential. He said even rights of animals were safeguarded under that Bill.
The Senior Minister said motivation and consultation policy would be adopted rather than using force in order to ensure evil-free environment. He asserted the Bill would greatly help in cherishing golden Islamic value wherein noble deeds would become easy and evils difficult to commit thus paving way for welfare society base on social justice.
To a question that why Hasba became essential when laws were already there for checking crimes, he said people were fed-up and disappointed of prevailing system due to lack of implementation on existing laws and thus they voted MMA into power on that very reason.
He said Hasba would play effective role that would be much more better than Ombudsman, NAB, RAB, Anti corruption and other such organisations that he ironically said were not being considered parallel bodies to the existing judicial system.
He said the Bill was framed in quite constitutional and Islamic framework that would greatly help and contribute to the judiciary and administration in implementing laws in an effective manner. He said Hasba was also in conformity with the institution of Ombudsman that was established in the Center in 1983 and later in other three provinces but could not be constituted in NWFP reasonably. The only difference he said would be 'Mohtasib' under the Bill would have additional knowledge of Islamic Shariah besides the existing qualification of judges.
Siraj-ul-Haq while answering a question said that Hasba Bill was drafted after consultation with all segments of society including Ulema, judges, lawyers, ladies & minorities. He added it was being considered at various governmental levels for last about two years that he asserted was also a proof of their patience and not haste as was alleged in propaganda against them.
However, he said even then they did not insist on its completion in all respects. "There is room for improvement in human efforts", he said adding, "we shall continue consulting the elite circles besides the assembly members under our policy of consultation in larger national interest in this respect."
To a question, he said Hasba Bill was resisted by central govt and not from any side of NWFP while center even moved it to Supreme Court. He said, "We are democrats and will not only fully defend our case but accept verdict of the higher judiciary with open minds anyhow". He, however, expressed confidence that judiciary would understand desire of people of the province and would thus provide relief to them.
He also asserted that President opposed the Bill just to please the West otherwise he supported such a 'harmless' act in heart. He hoped West would realise the ground facts on Hasba Bill instead of being influenced by negative propaganda against it as "Such is also norm of democratic and civilised nations to respect wishes of others", he concluded.
