ISLAMABAD: The Anti-Terrorism Court (ATC) on Thursday sentenced life imprisonment to three key suspects Khalid Shamim, Mohsin Ali and Mauzzam, of Dr Imran Farooq murder case and directed them to pay Rs1 million each as compensation money to the family of the slain.
The ATC judge Shahrukh Arjumand while announcing reserved judgement, also issued perpetual arrest warrants for MQM founder Altaf Hussain, Iftikhar Hussain, Muhammad Anwar, and Kashif Kamran in the Imran Farooq murder case.
According to the detail judgment, the accused, who are all holding nationality of Pakistan, by their acts are liable for exemplary punishment because they have tried to defame our motherland before the international community as the pre-planned murder of an innocent person was carried out in very organised manner in city of London having great importance.
It says that the prosecution remained successful in proving the case against accused by producing confidence aspiring evidence.
Case in hand, is a fit one for awarding death penalty, however, as an ordinance has been promulgated to amend Pakistan Penal Code 1860, whereby, in the cases, where evidence is shared by a foreign country, death penalty cannot be given.
The accused are thus convicted and sentenced as under; Syed Mohsin Ali is convicted and sentenced, (i) u/s 302 (b) read with section 120-B PPC to imprisonment for life, (ii) Under Section 7(a) of Anti-Terrorism Act, 1997 to imprisonment for life and a fine of Rs200,000/- is also imposed. In case of failure to deposit fine, accused shall further undergo simple imprisonment of six months, and (iii). Under Section 544 (A) CrPC accused to pay compensation of Rs1000,000 to the legal heirs of the deceased. In case of failure to pay compensation, accused to undergo SI for six months.
Accused Khalid Shamim and Moazzam Ali convicted and sentenced, (i) u/s 302(b) read with Section 109 PPC and 120-B PPC to imprisonment for life, (ii) Under Section 7(a) of Anti-Terrorism Act, 1997 to imprisonment for life and fine of Rs200,000 is also imposed on each accused. In case of failure to deposit fine, accused shall further undergo simple imprisonment of six months, and (iii) Under Section 544 (A) CrPC, each accused to pay compensation of Rs1000,000 to the legal heirs of the deceased.
Benefit of Section 382 (b) CrPC be extended to the three accused facing trial and all three sentences to run concurrently.
Certified copies of judgment be provided free of cost to the three accused and prosecutor. Case property be kept intact till the arrest and trial of four absconding accused.
It is expected from the governments of Pakistan and the UK that absconders will be traced, arrested and brought before court as soon as possible.
