The Supreme Court on Tuesday dismissed the bail application of a murder convict. A two-judge bench, headed by Justice Umar Ata Bandial heard the bail appeal of Javed Akhtar. Latif Khosa advocate, representing the petitioner, Javed Akhtar argued that one year ago his client had given an application to the police that the boys outside his house teased his daughters.
He said though at the time of murder he had a pistol but instead of opening fire, he hit the diseased with the pistol butt. He said that if he had to commit murder then why he had to hit the diseased with the pistol butt.
Justice Qazi Ameen asked the counsel what was written in the FIR. Khosa said according to the FIR his client did not have any enmity with the diseased.
The judge questioned whether the Supreme Court or the trial court that had to determine that the case fall under Section 319 of the CrPC. The counsel replied it was the trial court that had to determine this aspect.
Justice Ameen asked the counsel that he had approached the court for bail, and noted that since the case was before the trial court let it decide the matter. In the meanwhile, a bench headed by Chief Justice Gulzar Ahmed, dismissed the Pakistan Post appeal against the restoration of its employee Amna Rehman. The bench maintained the verdict of the Federal Services Tribunal.
The government lawyer said Amna was habitual at remaining absent from service. Therefore, the department removed her from the service. The chief justice noted that the lady was removed on the basis of only one day absence. He asked what inquiry was conducted regarding it. The counsel said Amna's appointment was declared "null and void" as it was not as per rules.
The chief justice said that the department should take action against those officials who appointed her. Justice Ijazul Ahsan observed that the lady had been working for the last eight years, adding now the department had come to court to send her home.
