Hyderabad Fund Case: government closely examining all aspects of UK's court judgement: FO

Foreign Office (FO) said on Wednesday that Pakistan is closely examining all aspects of the detailed judgment of a UK's court in the Hyderabad Fund Case and will take further action in the light of legal advice received. "Pakistan has taken note of the judgment by the High Courts of Justice of the UK in the Hyderabad Fund Case, Wednesday, after a two weeks trial in June 2019. The judgment rejects the longstanding claims of the two major parties and upholds the claims of the heirs of Nizam of Hyderabad," said Foreign Office Spokesperson Dr Mohammad Faisal.
He said that the ruling does not take into account the historical context of the transfer when India illegally annexed Hyderabad in violation of international law and all civilised norms, leading the Nizam of Hyderabad to make desperate efforts to defend his people and the state from Indian invasion.
He pointed out that the Nizam also raised the matter with the UN Security Council where the issue remains on the agenda to date. The Nizam as a sovereign approached Pakistan for assistance which the government of Pakistan provided, he added. "Pakistan is closely examining all aspects of the detailed judgment and will take further action in light of legal advice received," the spokesperson added.
A British court on Wednesday ruled in favour of India and Nizam's descendants, rejecting Pakistan's decades-old claim on a sum of one million pounds, which was transferred in 1948 to Pakistan's High Commissioner's account by the then ruler of Hyderabad for "safe-keeping". "Nizam VII (Mir Osman Ali Khan) was beneficially entitled to the fund and those claiming in right of Nizam VII - the Princes and India - are entitled to have the sum paid out to their order," Justice Marcus Smith of the Royal Courts of Justice in London ruled.
