The Supreme Court of Pakistan has observed that original jurisdiction of the court for an individual could not be invoked by filing a constitutional petition under Article 184(3) for enforcement of fundamental rights.
The court passed these orders while returning a petition filed by one Haji Javed Iqbal who approached the court for the recovery of Shakeel Ahmed from the illegal detention of Ali Muhammad and others.
The court, while returning the petition, observed that there is no matter of public importance with reference to enforcement of fundamental rights as was raised in the petition.
The petitioner through his counsel, M.D. Tahir, contended that Ali Muhammad and others kidnapped his son. The court, however, returned the petition and observed that under Article 184(3) petitions could only be filed in the matters of public importance with reference to enforcement of fundamental rights.
