A division bench of the Lahore High Court (LHC) has issued notice to SHO Changa Manga police station for April 25, and directed him to explain as to why police constructed police station on the land owned by the petitioner. The petitioner contended before the court that he had acquired the land in 1990 but the respondent SSP Kasur occupied the same and got the police station constructed there.
He approached the high ups but failed to vacate the land in question. He, therefore, approached the august court with prayer to direct the respondents to act in accordance with the law and vacate the land in question.
The LHC bench comprising Justice Ali Nawaz Chohan and Justice Umar Atta Bandial, after hearing the petitioner's counsel at length, issued notice to respondent SHO and called for a report till next date of hearing.
HEARING PUT OFF: An accountability court Monday adjourned the proceedings in a reference against federal minister, Syed Fasial Saleh Hayat, as the reference was placed before him on the orders of Chief Justice Lahore High Court over the request of the accused.
The court observed that it could not proceed further without examining the case file and adjourned the proceedings.
The accused has been facing the charges of being a wilful defaulter of some financial institutions.
LAW POINT: The Lahore High Court (LHC) adjourned the proceedings in a petition filed by one Ibrahim, to discuss law point whether or not the additional district and sessions judge could withdraw his own orders.
The petitioner contended that he had approached the respondent court against a police official. The respondent court directed the SHO Manawan to get registered a criminal case against the respondent police official. However, the respondent SHO failed to act in accordance with the law and the petitioner being aggrieved of this act, filed a contempt of court petition against the respondents before the respondent judge who had withdrawn his prior orders.
The petitioner counsel Ashar Jehangir contended that under the law, the respondent judge could not hear any petition or plea against his own orders.
He, therefore, prayed to the court to declare the orders of the respondent judge as illegal and passed without lawful authority.
The court, after hearing the petitioner's counsel at length, admitted the petition for regular hearing and put off the proceedings for discussing the law point on next date of hearing.
