ISLAMABAD: The Islamabad High Court (IHC) Justice Noorul Haq N Qureshi Friday dismissed petition of Commodore Pakistan Navy, Muhammad Shakeel Naz against his dismissal from services by an army court.
The petitioner's counsel took the stance that trial decision was malafide, and without jurisdiction.
During the course of proceedings, Deputy Attorney General (DAG) Raja Khalid Mahmood apprised the court that applicant as a project director leaked some secret official information to the contractor.
Being a Project Director, he also established a private company while using his official authorities and sources which was sheer violation of the rules and regulations, he added.
DAG apprised the court that, the applicant through court-martial was punished for six months imprisonment and termination from his service.
Later the appellate court of the army maintained the imprisonment however Naval Chief waived six months imprisonment but upheld dismissal from service.
While investigating some cheque amount of 2.2 millions of Brunei dollars and disks having official material were also found from the accused house.
He said army court announced punishment according to his jurisdiction authorities, however the civil courts had no jurisdiction to hear any writ petition against the Army Courts, and he cited some precedents of the apex courts to support his stance.
The court after hearing the arguments dismissed the writ petition of the applicant.
