imageISLAMABAD: The Supreme Court on Tuesday directed the National Accountability Bureau (NAB) Chairman to submit reply for not taking action on an application after a period of five years.

The court also issued notices to Bahria Town, Defence Housing Authority (DHA) and Habib Rafique company in the case.

The three-member bench of the apex court headed by Chief Justice Jawwad S. Khawaja comprising Justice Dost Muhammad Khan and Justice Qazi Faez Isa heard the petition filed by Tariq Kamal against the NAB Chairman for not taking any action on his application.

During the course of proceedings, Tariq Kamal informed the court that the DHA received money from the people in the name of DHA Valley and then transferred the project to Bahria Town without doing any work on the housing project.

He said that six agreements were signed between Bahria Town and DHA where no guarantee was ensured for masses.

He said that the agreement was done between the parties for an area of 40,000 kanals and one plot cost Rs 3.8 million. A total sum of Rs 100 billion was transferred to Bahria Town accounts according to the record of the DHA.

He said that an application was filed in NAB on December 16, 2010 but the Bureau did not take any action on his application.

The court asked the Prosecutor General NAB whether any action was taken on the application.

On which the NAB Prosecutor replied that the action was initiated on the application on July 16, 2015.

The counsel for Bahria Town sought time for preparation of the case and said that his client sought adjournment in the case.

Later, the court issued notices to DHA, Bahria Town and Habib Rafique Company, sought reply from the NAB Chairman and adjourned hearing of the case till September 21.
