imageISLAMABAD: The Islamabad High Court (IHC) will hear Disqualification appeal of Raheela Magsi from Senate Elections and petition moved by Sheerin Mazari, leader of PTI in this regard on March, 4 jointly.

A division bench of Justice Athar Minnallah heard the appeal filed by Raheela Magsi leader of Pakistan Muslim league Nawaz (PML- N) against her disqualification from contesting senate election on the basis of domicile.

During the course of proceedings, Syed iftikhar Gilani, counsel for the Magsi pleaded before the court that transfer of vote could not be the basis of rejection of the nominations.

He further stated while citing the Section 20 of the Electoral Rolls Act regarding transfer of votes that it did not apply for senate elections.

The counsel pleaded before the court that election commission cleared some other candidates who transferred their votes and added that disqualification of Magsi is an act of discrimination.

Gillani said that her client had property in the federal capital and had constitutional right to transfer her vote to the capital from any province.

The court remarked that, why the appellant not approach to the Election Tribunal (ET) as in the case of Javed Hashmi the court directed that any candidate should approach ET.

Gillani, while presenting a precedent stated that later in another similar case the court allowed the affecttee to approach High Court in the election matter.

If the senate elections conducted there would be no remedy available for his client he added.

The court observed that it could not decide the matter without hearing of all litigants and adjourned the matter till March 4 while directing the all parties to come on next date of hearing.

Magsi, a candidate of the Pakistan Muslim league Nawaz (PML-N) was contesting Senate election on the women's reserved seats from the federal capital.
