A division bench of Sindh High Court (SHC) on Monday issued notices in a petition seeking removal of chairman, Mohajir Qaumi Movement-Haqiqi (MQM-H) Afaq Ahmed's name from Exit Control List (ECL).
The bench comprising Justice Maqbool Baqar and Justice Nisar Muhammad Sheikh after preliminary hearing of the petition filed by Iqbal Kazmi as attorney of Afaq Ahmed, ordered issuance of notices to respondents Federal Secretary Interior and Director Immigration and Passport, Karachi to appear on March 2.
The petitioner submitted that on January 7, 2012, he (Afaq) contacted the concerned office for getting passport as he intends to go to Saudi Arabia for performing Umrah but he was refused as his name has been placed on ECL.
He maintained that the act of the respondents is unlawful under the articles 4, 9,14 and 15 of the constitution.
He prayed the court to declare the action of the respondents as unlawful and order for removal of his name from the list. He also prayed to order the respondents for issuance of passport to him.
