ISLAMABAD: The Accountability Court has ordered relevant authorities to auction former prime minister Nawaz Sharif's properties who had been declared a proclaimed offender in the Toshakhana reference involving former president Asif Ali Zardari, former premier Syed Yousaf Raza Gillani, and others.

The Accountability Court-III judge, Syed Asghar Ali, approved the National Accountability Bureau (NAB)'s petition seeking to allow auction of properties owned by the accused, Sharif.

According to the court order, an application has been submitted by the NAB regarding issuance of directions to the concerned authorities regarding sale of the attached properties of proclaimed offender accused namely, Mian Muhammad Nawaz Sharif under section 88 of CrPC.

The perusal of the record has revealed that the accused namely Mian Muhammad Nawaz Sharif has been declared as Proclaimed Offender (PO) by this court on October 9, 2020 in accordance with the provisions of 87/88 of CrPC.

This court had ordered the attachment of properties of the accused, Sharif. Consequently, six objection petitions have been filed before this court with respect to some of the attached properties of aforementioned, the accused.

However, there are certain attached properties against which no objections/claims have been preferred before this court till date, whilst, accused has not surrendered before this court even after lapse of six months from the date of the said order of the attachment of properties.

Therefore, in view of the available record and in order to procure the attendance of the said accused, the application filed by the NAB is allowed and concerned authorities, on whose disposal the attached properties, are directed under section 88 of CrPC to sell out the attached properties against which no objections/claims have been preferred before this court and deposit the proceeds of the sale of the properties as per following directions.

It says that the chairman Securities and Exchange Commission of Pakistan (SECP) is directed to sell the attached shares held by the accused in different companies and proceeds of the same be deposited with state treasury within 30 days after receipt of this order under intimation to this court.

The details of the shares already attached by this court includes Mohammad Bakhsh Textile Mills Limited 4,67,950 shares, Hudaibiya Paper Mills Limited 3,43,425 shares, Hudaibiya Engineering Co (Pvt) Limited 22,213 shares, and Ittefaq Textile Mills Limited 48,606 shares.

The court also directed the Deputy Commissioner (DC) Lahore and the DC Sheikhupura to sell the attached immoveable properties held by the accused in their jurisdiction and proceeds of the same be deposited with state treasury under intimation to this Court within 60 days after receipt of this order. The details of the properties attached by this court include 135 Upper Mall Lahore, agricultural land 936 K-10M85 F at Mouza Manak Lahore 12 acres (Guava Orchid), agriculture land 299 K-12M85 Mouza Badokisani Lahore 24 acres 2 kanals (Fish Farm), agriculture land 88 K-04.5M at Mouza Ferozwattan, District Sheikhupura.

As per the court order, the Excise and Taxation Officer (ETO) Lahore has directed to take into possession the vehicles including Toyota Land Cruiser Model 2010 LEB-10-1957, Mercedes Model 1973 LHD-2BO, Mercedes Benz Model 1991 IDH-78, Tractor Model 2011 LES-11~7786, Tractor Model 2015 LES-1S-6024 with the assistance of local police, and sell the same and deposit the proceeds of sale in favour of state treasury under intimation to this court within 60 days after receipt of this order.

The court also directed manager MCB. New Garden Town, Lahore, manager Standard Chartered Bank, Gulberg Islamic Branch, Lahore, manager Standard Chartered Bank, Wapda Town, Lahore, manager Allied Bank Limited, New Garden Town, Lahore, Manager Bank Alfalah, Y-Block, Defence Branch, Lahore to transfer the available funds in bank accounts in favour of state treasury within 30 days after receipt of this order.
