The Supreme Court barred Pakistan Tehreek-e-Insaf leader Sardar Sher Bahadar from filing nomination paper for the slot of district nazim Abbottabad. Sardar Sher Bahadur was elected on PTI ticket, but he changed his loyalties for the district council election, to which the PTI issued notice to him for violating the party's code of conduct.
Consequently, Election Commission of Pakistan had de-seated him on the application of PTI. Later he challenged the ECP verdict before Peshawar High Court. Maintaining the ECP decision, the High Court dismissed his plea and finally he invoked the apex court jurisdiction against the PHC decision.
Resuming the hearing of the appeal, a three-member bench of the Supreme Court led by Chief Justice Mian Saqib Nisar issued notice to all the parties of the case saying till final adjudication of the matter Sher Bahadur would remain suspended. Chief Justice Mian Saqib Nisar observed the court shall examine whether or not under the provisions of Peoples Representative Act Bhadur can contest the election, adding that every candidate is bound to follow the party's code of conduct.
Turning down the request of the appellant's counsel for permission to file nomination papers on April 19, the bench said the court cannot grant the permission without examining all aspects of the case. Hearing of the matter was adjourned for two weeks.
