Lahore High Court (LHC) has vacated stay order granted to commercial importers against anti-dumping proceedings initiated on the request of tiles and paper industry by National Tariff Commission (NTC). Sources told Business Recorder here on Monday that LHC had fixed the hearing in cases of tiles and paper industries on December 21, 2016.
The court has vacated the earlier granted stays in tiles and paper cases. Following the orders of the LHC, anti-dumping proceedings would be resumed in cases of tiles and paper industries by the NTC.
The applications for vacation of stay from petitioners were also filed by Azeem Danial Advocate in tiles case and Shehzad Ataa Elahi Advocate in papers case. The NTC lawyer Ahmed Sheraz was also present. The counsel of local industry had filed applications for vacation of stay and early hearing, pleading that NTC had been made fully functional by the federal government vide issuance of five different notifications for each of the five members, one of whom was the chairman. This fact was brought to the notice of the court by the lawyer and the judge asked him to produce copies of the notifications.
According to the order of the LHC, "Be that as it may, whether or not there is a lawful commission under notification of 5.9.2016 is a separate issue. The contentions raised on 8.12.2016 by the petitioner (commercial importer) were specifically with reference to the judgement dated 15.3.2016 passed in WP No 4735/2016, which had directed that new members be appointed and which had saved the notice of initiation. At present for now, there is commission which is functional and any challenge raised to its legality is yet to be argued. Therefore, the stay granted vide order dated 8.12.2016 is recalled, CM stands disposed of," LHC order added.
