Barrister Zafarullah Khan of the Watan Party on Saturday challenged the formation of commission to investigate the Panama Papers Leaks. According to sources, Zafarullah Khan, whose petition was disposed of by the Supreme Court in the Panama case last month, filed another petition in the apex court, challenging the formation of a single-member judicial panel that was proposed by Chief Justice of Pakistan Anwar Zaheer Jamali.
The CJP, while hearing the case on Tuesday, said a single-member bench comprising a sitting judge of the Supreme Court will be constituted for investigation into the scandal, adding that the commission will have all the powers. In the application filed by Barrister Zafarullah Khan, who supports constitution of a parliamentary committee or a panel to look into the Panamagate scandal, has submitted that the court can't constitute a commission since the Enquiry Commission Bill 2016 is already pending n the Parliament for approval.
"Supreme Court is not entitled to make TORs for the inquiry... The Parliament is mother of all institutions while courts are bound to implement the Parliament's legislation," he said. "It's not in court's jurisdiction to hear a dispute of a political family," he said, adding that such cases could be exploited by anti-judiciary elements.
