Appeal against IHC order for removal of road encroachment declared non-maintainable

ISLAMABAD: A division bench of the Islamabad High Court (IHC) Tuesday declared an appeal of the Ministry of Defence challenging the single-member bench's interim decision regarding removal of encroachments from the Aabpara Road non-maintainable.
The bench comprising Justice Aamer Farooq and Justice Mohsin Akhter Kiyani conducted hearing of the intra court appeal (ICA) of the ministry along with the objections of Registrar Office.
The court observed that it could not issue an order against the interim decision of single member bench and declared the ICA non-maintainable.
The IHC bench comprising Justice Shaukat Aziz Siddiqui on June 22 had ordered the Capital Development Authority (CDA) to submit implementation report after removing encroachments from the Aabpara Road.
