Section 88 of Criminal Procedure Code: Court may order Musharraf's property confiscation

After expiry of seven-day deadline given to former military dictator General (Retd) Pervez Musharraf, it is expected that under section 88 of Criminal Procedure Code, Court might order confiscation of property of Musharraf on June 11, the next hearing of the Benazir Bhutto assassination case.
The court had declared Pervez Musharraf proclaimed offender on May 30, in high profile assassination of former Prime Minister Benazir Bhutto along with 26 other people, for his constant absence from hearing. Judge of the Anti Terrorist Court (ATC) III, Rana Nisar Ahmed after declaring Pervez Musharraf proclaimed offender on May 30, had directed the prosecution to publish the advertisement of his abscond in national newspapers giving seven-day time to former military ruler to appear before the court by June 7.
But Pervez Musharraf has failed to appear before the court in person or through his counsel. The advertisement was published in national newspapers on June 1, in which it was mentioned that if former president failed to appear before the court within seven days, the court will start proceedings to impound all his movable and immovable property by using its powers under section 88 of the Criminal Procedure Code.
It was learnt that no reply was filed in the court till Wednesday, the expiry of the court deadline of June 7. The court had earlier issued arrest warrants of Pervez Musharraf in this case, in which he was nominated as main accused, and court ordered the Federal Investigation Agency (FIA) to submit compliance report of the arrest warrants.
