All Pakistan Ceramic Tiles Manufacturers Association (APCTMA) has clarified that Lahore High Court (LHC) has not granted stay order to importers in fresh petitions filed in tiles cases which are fixed for final arguments on March 10, 2017. Responding to a media report about fresh stay granted to importers by LHC, the APCTMA has issued a statement here on Monday to dispel the impression that any new stay order has been granted by the court.
According to a statement of the APCTMA issued here on Monday, Justice Ayesha A Malik of LHC issued order on various writ petitions filed by different importers challenging actions taken by National Tariff Commission (NTC) in anti-dumping proceedings. The judge has not granted stay order to importers in fresh petitions in tiles cases and fixed the case for final arguments on March 10, 2017.
Counsel for the appellants/petitioners argued before the court that the appointment of chairman and other members of the National Tariff Commission (NTC) were not lawful. The Deputy Attorney General requested the court to allow some time to the Federation to file comments. However the counsels for the domestic industry Shehzad Ata Elahi and Muhammad Azeem Danial apprised the court of the hierarchy of events and argued that anti-dumping proceedings were time-bound investigations and the actions of the Commission must be saved.
