Turning down the plea for stay order against construction of flyover near Halla Naka of district Hyderabad, the Supreme Court on Monday issued notices to chief secretary and concerned officials of the provincial government. A 2-judges' bench led by Justice Ejaz Afzal Khan, issued the notices while hearing Muhammad Ashraf's appeal filed against Sindh High Court's verdict, seeking court's directives to halt the construction of the flyover.
Appearing on behalf of the petitioner, Mushtaq Ahmed Mohal apprised the bench that his client acquired the land from Municipal Corporation Hyderabad on the lease of 99 years for freight forwarding business where the provincial government has allowed the construction of flyover.
Terming the provincial government's permission to construct flyover on the leased land breach of his client's right, Advocate Mohal urged the apex court to grant stay order. However, Justice Ejaz Afzal Khan said in his remarks that both the parties were claiming ownership of the land in issue, saying it is an issue of demarcation of land which has not been settled by the concerned authorities. Later, hearing of the matter was adjourned for a week.
