ISLAMABAD: The Pakistan Bar Council (PBC) and the Supreme Court Bar Association (SCBA) reiterated their support for the establishment of the Federal Constitutional Court (FCC) through the 27th Amendment.
In a joint statement issued here on Saturday, Vice-Chairman PBC Ch Tahir Nasrullah Warriach and President SCBA Haroon-ur-Rashid stated that it had been their demand for almost two decades for the establishment of the FCC with equal representation of the provinces to hear constitutional and political matters, so that cases of the general public could be resolved and decided by the Supreme Court promptly.
The two top lawyer bodies said, “It (FCC) will strengthen the federation.” “We are watching the whole process, including the appointment of judges, and will express our concerns and grievances through our decision and resolutions duly adopted by the General Houses of both the Bar bodies,” the statement further said.
It also stated that the PBC and SCBA have always stood for upholding the rule of law, the independence of the judiciary, the supremacy of institutions, and adherence to the Constitution.
Both the Bar bodies noted that certain political factions within the legal community are attempting to create chaos and division among the lawyers’ community, just to achieve their ulterior political motives and to advance their political agenda. They often issue statements aimed at sabotaging the democratic system of the Country. “We strongly reject and condemn such statements issued by the non-elected people and assure that their futile exercise will soon be rendered ineffective,” said the elected representatives.
They made it clear that the PBC and the SCBA, being apex bodies of the legal fraternity, are only supposed to issue statements on behalf of both these institutions on national issues; therefore, so-called statements are an individualistic and minority view and do not represent/reflect the stance of the Bar Council, Bar Association, and the entire legal community. The individual statements amount to a minority dictating the majority. The entire legal fraternity stands firmly with the Rule of Law and upholding the Constitution of Pakistan.”
