The Supreme Court on Friday allowed the Khyber-Pakhtunkhwa government to recruit people in Grade-11 and above post through the Public Service Commission (PSC). A two-judge bench, headed by Chief Justice Gulzar Ahmed, heard the petitions of various employees of the Social Welfare Special Education Department KP.
The bench ordered the government to complete the recruitment process within six months. The chief justice said the petitioners could apply for the posts again. It said those employees who did not fall under the KP Employees (Regularization of Service) Act, 2018 could not be regularised.
The court said unless the government recruited new employees the present would continue to work. Additional Advocate General KP Qasim Wadood contended that this case was decided by the high court on merit. He requested the bench to grant sometime for further preparation.
Wadood said that Employees (Regularisation of Service) Act was applied to the instant case, adding according to the act only those employees could be regularized, who were part of the projects before 2015. The chief justice inquired from lawyer of employees whether his clients were part of the projects. He replied "no".
Justice Ijazul Ahsan questioned that if the projects had been changed then could these employees be regularized?
He said they would examine whether the projects were converted?
The additional advocate general said if those employees would be regularised then a pandora box would open.
He said that if they would be regularised then those appointed in 2019 or 2020 would also approach the court. The bench ordering the KP government to recruit through Grade 11 and above employees through Public Service Commission disposed of the petitions.
