A division bench of the Lahore High Court on Wednesday sought a report from the home department by March 7 about detention of Jamatud Dawa's chief and other aides. JuD Chief Hafiz Muhammad Saeed and his aides had challenged their detention ordered by the provincial government. AK Dogar Advocate, representing the petitioners, stated that the Punjab government in the light of interior ministry's order detained them for a period of 90 days in exercise of powers under section 11-EEE(1) of Anti Terrorism Act 1997.
He contended that Interior Minister Ch Nisar Ali Khan in a statement said the government was fulfilling its obligations under the UN resolutions. He said by doing so the government proved that the Pakistan was a servile and a dependent nation. He further pleaded that the impugned orders issued by the government is without jurisdiction.
He said the government had no evidence that the petitioners are risk to security of Pakistan and merely on the basis of the UN resolutions their liberty cannot be curtailed. He therefore prayed to the court to set them at liberty after setting aside the impugned notifications.
