ISLAMABAD: Judge of the Islamabad High Court Justice Mohsin Akhtar Kayani on Wednesday ordered that the IHC's Practice and Procedure Rules be uploaded on the court’s website within 48 hours.
He also directed that the copies be provided to the Islamabad High Court and district bar associations.
Justice Kayani issued the directives during hearing of a case when the court asked a lawyer about the Practice and Procedure Rules. In response, the petitioner’s lawyer said that he was unaware of the details of the rules and was submitting an application to obtain them.
At that Justice Kayani said that they framed those High Court rules which they themselves did not receive. He added that he is a judge and he did not receive them then how would you receive them?
The judge noted that although the full court had framed and approved the rules, yet the same were neither circulated nor made public.
Justice Kayani directed the lawyer to write to the registrar to obtain the rules. When the lawyer said he had contacted the Ministry of Law and would also submit an application, the judge expressed his concerns over delays. The judge added that even available records were often withheld for months.
Justice Kayani said that he had directed that the rules be uploaded on the website within 48 hours and warned that criminal proceedings could be initiated if the order was not implemented. He further said that he would summon the registrar if required.
When the lawyer requested the next hearing be fixed for January 29, the judge responded that he did not know whether he would be there on the 29th or not. Later, the court deferred the hearing.
