LAHORE: The Lahore High Court (LHC) Chief Justice has constituted a full bench headed by Justice Sadaqat Ali Khan to hear multiple petitions challenging the 27th constitutional amendment.
Justice Jawad Hassan and Justice Sultan Tanveer are the other members of the bench. The petitioners include bar members Munir Ahmad, Mian Shabbir Ismail and a citizen Hassan Latif. The petitioners argued that the amendment conflicts with the basic structure and spirit of the Constitution of 1973.
LHC judge recuses himself from pleas against 27th Amendment
The impugned amendment, they said, is also against Islamic provisions, judicial independence, and fundamental rights. They contended that the 27th Amendment restructured the apex court by introducing a new Federal Constitutional Court. They said the amendment restructured the apex judiciary of Pakistan by creating a Federal Constitutional Court (FCC). They argued that the amendment threatens to weaken the Supreme Court’s status and jeopardize judicial independence.
The petitioners asked the court to strike down the 27th constitutional amendment and to suspend its implementation until a final verdict of the court.
