The Lahore High Court (LHC) here on Wednesday restrained Evacuee Trust Property Board (ETPB) from selling out land attached to a Gurdwara in Lahore Cantonment without prior permission of the court. The court also directed deputy administrator ETPB to produce all record of the land attached to Gurdwara Bibi Nanki on next hearing.
The court was hearing a petition against possible sale of 114 Kanal land to DHA. Earlier, a deputy administrator of ETPB appeared before the court and undertook that the land in question would not be disposed of.
The court remarked that it would protect rights of minorities at any cost and all the land disposed of by ETPB would be retrieved. The petitioner, Gulab Singh, who is the member of management committee of Bibi Nanki Gurdwara Trust contended that a huge portion of land was attached to Gurdwara.
He said being the trust property it should be preserved but ETPB had already disposed of most portion of the land to DHA. He pointed out the respondent (board) is now bent upon to sell the remaining 114 Kanal land to DHA too. He approached chairman ETPB with a request not to sell the said property and transfer the same to Gurdwara for its expansion but he paid no heed.
He said respondent-board is custodian of trust property and could not dispose it of except under exceptional circumstance. He said the possible sale would be sheer violation of Evacuee Trust Property (Management) Act 1975.
