Terming the FATA and PATA regulations as negation of all humanitarian laws, Jamaat-e-Islami (JI) on Friday called upon President Asif Ali Zardari to withdraw the regulations otherwise it would start movement that could also extend to besiege Awan-e-Sadr and Prime Minister House.
Speaking at a news conference, JI's Senator Ibrahim strongly criticised these regulations, signed by the President on June 23, 2011, terming them as violation of all humanitarian laws. The regulations include the Actions (in Aid of Civil Power) Regulation, 2011 for FATA aimed at providing for actions in aid of civil power in the Federally Administered Tribal Areas and secondly Actions (in Aid of Civil Power) Regulation, 2011 for PATA to provide for actions in aid of civil power in Provincially Administered Tribal Areas.
Referring to clause 3 of the article 1 of the Actions (in Aid of Civil Power) Regulation, 2011 for FATA, the Senator said that according to the clause the regulation shall come into force at once and shall be deemed to have taken effect from February 1, 2008, which he said was aimed to provide legal cover to the alleged extra-judicial killings that have taken place during the army operations against the miscreants.
Referring to clause 3 of article 16 of Chapter VII, he said that a person whosoever obstructs or attempts to obstruct in any manner the actions in aid of civil power or threaten in any manner whatsoever the peace and tranquility of any area by subversion, spreading literature, delivering speeches electronically or otherwise thus inciting the people in commissioning any offence under any law shall be deemed to have committed offences under the regulation. And the punishment under the regulation, as clause 1 of the article 17 stated that whosoever commits an offence under this regulation shall be punished with death or imprisonment for life or imprisonment up to 10 years and may also be liable to fine.
Referring to clause 1 of article 18, which tells about the prosecution, Ibrahim said that it was ironical that offender will be prosecuted under FCR which even does not have the death penalty. Commenting on the clause 2 of the article 19 of the regulation, he said that it has been stated that statement of a single armed force personnel was enough as evidence to punish any person for the offences mentioned in the regulation.
The JI leader strongly opposed the Regulation and urged President Zardari to withdraw it by making an apology before the nation for allegedly giving go ahead to the extra judicial killings in the FATA and PATA areas of the country. He warned that if the regulation, which he described as 'black laws', were not taken back, the JI would launch a movement which initially would include organising seminars in all big cities that would be followed by besieging Governor House and Chief Minister House of KP and if again the government did not withdraw the regulation, then his party would also give a countrywide call to besiege Awan-e-Sadr and Prime Minister.
