Senator Anwar Bhinder here on Tuesday organised a one-day seminar with the co-operation of the IPU and the UNDP on 'Legislative Drafting'. In his opening remarks, Bhinder said that it is the parliamentarians' dream to pilot original piece of legislation.
Which would immortalise his name in history books.which coincided with the arrival of IPU secretary general Anders B Johnsson in the city. Bhinder observed it was difficult to write original (piece of) legislation but if a parliamentarian could do it, he would leave behind a lasting name among the future generations. It was equally difficult to sponsor a piece of legislation aimed at amending the constitution, he added.
The amending bill might contain beneficial proposals, which might be supported by the opposition but the test is whether it had enough political will to support it.
Usually political expediency prevented appreciation of bills introduced by the other side. Bhinder listed six important ingredients of good drafting, among which the language of the bill is the most important ingredient.
The language must be clear and easy to understand even for a layman. In this regard, the Senator particularly referred to the Hudood Laws that were full of difficult phraseology that even a judge had difficulty to understand them.
Generally, every legislator should work hard in drafting legislation to garner support from the public. While doing this the lawmaker must research whether similar laws were available either in the centre or in the provinces as well as ancillary judgements given by the courts to better explain the law.
