The Lahore High Court directed law officer to conclude his arguments in a petition of Jamatud Dawa Chief Hafiz Muhammad Saeed challenging his and his aides' detention and adjourned the proceedings to April 4. The petitioners' counsel, AK Dogar, submitted that detention order of his clients was based on malafied intentions of the government.
He said only the federal government can include name of anybody in 4th schedule and not the provincial government. He said the Punjab government has issued notification for inclusion of names of his clients in 4th schedule which is illegal and unconstitutional.
Dogar further submitted before the court that his clients are serving the humanity. He said his clients were detained under pressure from the US and India instead of dealing the matter in accordance with law of the land. In reply to the petition, the law officer submitted that the federal government had informed that the Jamatud Dawa and Falah-e-Insaniat Foundation that they are engaged in certain activities which could be prejudicial to peace and security and violation of Pakistan's obligations to the UN Security Council resolution, hence the names of the petitioners were placed in the 4th schedule and they were detained for a period of 90 days on January 30.
He said they can file representations against their detention orders before the home secretary according to the law and asked the court to dismiss the petition. The Punjab government on January 30 had detained Hafiz Saeed, Abdullah Ubaid, Malik Zafar Iqbal Shahbaz, Abdul Rehman Abid and Qazi Kashif Hussain for 90 days.
