Supreme Court Bar Association (SCBA) has expressed its concern over the resolution for appointment of Justice Khalil-ur-Rehman Ramady and former Justice Rehmat Jafri as ad hoc judges for one year term, unanimously passed in a full court reference of the supreme court. SCBA president, Asma Jahangir while addressing a press conference here Tuesday said bars would resist the decision once it would come into judicial commission to finalise the appointments.
Asma Jahangir said that the judges, by adopting a resolution for appointment of ad hoc judges, have taken a political step and lawyers would also handle it politically. She said bars are showing strong resentment against the resolution and they must show resistance in this regard.
She also said that there should be a difference between trade union, political party, bar council and judiciary, and added such acts do not suit the judiciary as they are against its own decisions. She said that one should practice what one preaches.
She demanded the government not to adopt the policy of leniency in making appointments of judges. Although the resolution passed by the full court has no legal authority nor it could make appointments, but the judges should think before taking such steps. She said that she herself avoids uttering such words which would hurt the feelings of judiciary but in this matter, one of the beneficiary judges was also present in the meeting, which does not suit the judges.
SCBA president said ad hoc judge could only be appointed in case of emergency when there is dire need of one because appointing a judge on ad hoc basis would ruin the image of judiciary. She said she respects Ramday very much for his one or two good decisions but his presence in the bench is considered to humiliate the lawyers and litigants. She said no one is indispensable for any seat. She demanded that additional judges should be confirmed and SC judges should review their resolution passed for appointment of ad hoc judges.
