Chief Justice Mian Saqib Nisar on Saturday said that during his meeting with Chinese Chief Justice he found him very anxious. Before chairing a meeting of National Judicial (Policy Making) Committee (NJPMC), the Chief Justice told apex court reporters that during his visit to China to attend a Chief Justices meeting, he met the Chinese Chief Justice who was keen to develop a mechanism for individuals or companies of China operating in Pakistan in relation to the China Pakistan Economic Corridor (CPEC) business.
Recalling his meeting with outgoing Chinese ambassador, the Chief Justice said the ambassador too underscored the need for expeditious and amicable disposal of cases.
The Chief Justice categorically said that Pakistani judiciary has nothing to do with executive business in the CPEC, adding that at the same time it is important to mention that China is a great friend of Pakistan so the judiciary should address any anxiety of Chinese judiciary about the CPEC litigations in Pakistan.
He said there is no objective of the apex court to erode the executive''s role but to support and develop a mechanism for arbitration to implement international arbitration award in order to make decision for attraction of foreign investors who should not feel the burden of litigation.
Chief Justice Mian Saqib Nisar said that like human ailment, litigation is the ailment of society, adding the courts can decide matters in accordance with law by developing a substantive approach. According to him, mediation has turned out to be a very effective tool to resolve issues.
Separately, while addressing the chief justices of all the high courts, judges of special tribunals and administrative courts and media of the country in the Supreme Court, Chief Justice Mian Saqib Nisar raised his hand, asking the judges to ensure delivery of quality justice to the people of Pakistan in the existing framework of law.
Chief Justice Mian Saqib Nisar also asked judges to stay away from protecting any effort to derail democracy, saying that judiciary has to dispense justice across the board without any fear or favour. He maintained that courts are an important pillar of any state, adding that in case such pillar does not perform, the state will lose its balance.
Chief Justice Mian Saqib Nisar said that Parliament is the supreme body while asking the judges to deliver in the existing framework of the laws without waiting for new laws because people need justice.
