The Lahore High Court on Friday adjourned the proceedings till March 20 in a petition filed against acceptance of nomination papers of PPP leader Babar Awan in senate elections. A.K Dogar advanced his arguments on maintainability of the petition. The petitioner Shahid Jami alleged that Babar Awan accumulated assets, which mismatched with the amount of income tax paid by him.
He submitted that Awan assets had increased from Rs 46370000 in 2006 to Rs 328703323 in 2011. He said that Awan had ridiculed higher judiciary for which Supreme Court had already suspended his license. He submitted that Awan is registered as voter in Rawalpindi whereas he lives in Islamabad and has no property in Rawalpindi. He requested to set aside the order of election commission about acceptance of nomination papers of Awan.
The counsel Barrister Syed Ali Zafar pleading for Awan submitted that on the basis of established principles of law the instant petition was not maintainable and liable to be dismissed because it only contained allegations without any conclusive evidence or proof. He pleaded that under Article 225 of the Constitution, any dispute relating to election, including questions of qualification or disqualification of a candidate could be decided by high court in writ jurisdiction and the only remedy was to file an election petition before an election tribunal after the election.
