The implementation commission on the constitutional amendments has directed the Federal Board of Revenue (FBR) to review the existing tax laws with reference to the amendments made in entries numbering 49 and 50 of the Part-I to Fourth Schedule of the Constitution of Pakistan 1973.
Sources told Business Recorder here on Sunday that the entry number 49 of the Part-I to Fourth Schedule of the Constitution is related to the taxes on the sale and purchase of goods imported, exported, produced, manufactured or consumed except sales tax on services. The entry number 50 of the Part-I to Fourth Schedule of the Constitution is related to the taxes on the capital value of the assets, not including taxes on immovable property. The implementation commission wanted to ensure that the FBR is collecting taxes on all those items which are covered under the Federal Legislative List as amended by 18th Constitutional Amendment.
Sources said that the implementation commission on the constitutional amendments has issued instructions to the FBR in this regard. The implementation commission has advised the FBR to review the existing tax laws with reference to the amendments made in entry number 49 and 50 of the Part-I to Fourth Schedule of the Constitution to ensure that domain of federation is extended only to those taxes which were covered under the Federal Legislative List.
All Wings of the FBR are compiling their views on the existing tax laws and after the completion of review exercise a report would be prepared so that it can be consolidated and forwarded to the implementation commission, sources said.
The FBR has further directed its Wings that the directions of the implementation commission may be implemented and a report on issues relating to 18th Constitutional Amendment be forwarded to FBR Legal Wing for onward submission to implementation commission.
