One of the PCO judges Justice Sajjad Hussain Shah of Lahore High Court Tuesday tendered unconditional apology in the court for taking oath under Provisional Constitutional Order (PCO) on November 3, 2007. Sheikh Zameer counsel for Jusice Sajjad Hussain Shah submitted unconditional apology to the bench pleading that his client is embarrassed for his action.
Whereas another PCO Judge Justice Shabar Raza Rizvi flied another miscellaneous application requesting the court to issue contempt of court notices to the former President Pervez Musharraf and the then corps commanders because they had also violated the restraining orders of seven-member Supreme Court bench against imposition of emergency on November 3, 2007.
Dr Khalid Ranjha, a counsel for former chief justice Lahore High Court, Chaudhry Iftikhar Hussain pleaded before the four member-bench of the apex court headed by Justice M.A.Shahid Siddiqui with Justice Jawad S.Khawaja, Justice Khilji Arif Hussain and Justice Tariq Pervez that his client accepts the verdict of seven-member bench and his client took oath because he was not provided the copy of decision till he took oath under PCO.
Dr Abdul Basit, the counsels for PCO judge Justice Shabbar Raza Rizvi and Justice Hasnat Ahmed resumed his arguments. Basit said that his client has raised a question in his application that whether the country is being governed by the armed forces or people. He said the November 03, 2007 restraining order was not only for judges but the army was also bound to follow the court directives but they defied the apex court derives hence equally accused of defying the court orders.
He said Judges were pressurised to take oath under PCO and they did not offer their services themselves. He further said that the entire world is observing this case and the impression is being drawn that the court is not issuing notices to all the accused including army who violated court orders of November 3, 2007, adding that the court should not afraid of army while issuing notices to generals.
The court has been conducting the proceedings of the cases of former chief justice Abdul Hameed Dogar, and former chief justice of Lahore High Court, Iftikhar Hussain Chaudhry. The cases of eight sitting judges are being heard for taking oath under PCO. They included Justice Syed Zahid Hussain, Justice Khurshid Anwar Bhinder, Justice Hamid Ali Shah, Justice Zafar Iqbal Chaudhry, Justice Hasnat Ahmad Khan, Justice Syed Shabbar Raza Rizvi, Justice Yasmin Abbasi and Justice Jehanzeb Rahim.
