IHC reserves decision on maintainability of plea about MNAs funds
ISLAMABAD: The Islamabad High Court (IHC) on Monday reserved its judgment on maintainability of a case filed by a Pakistan Muslim League Nawaz (PML-N)’s MNA against alleged allocation of CPEC’s funds for MNAs development projects.
Chief Justice Athar Minallah remarked that these matters shouldn’t be referred to the court. It would undermine the supremacy of the Parliament if such petition was fixed for hearing, he added.
The IHC Chief Justice heard the case filed by PML-N’s MNA Barrister Mohsin Shahnawaz Ranjha regarding the matter.
The petitioner had claimed in his plea that the Rs 24 billion from CPEC funds may be allocated for the development projects of MNAs.
He said that the Ministry of Planning was not sharing the information with him despite of a proper request.
At this, chief justice remarked that the petitioner was himself a member of Parliament and could use his powers at that forum for this purpose. It would challenge the supremacy of Parliament if such petition was fixed for hearing, he added.
Parliamentary issues shouldn’t be dragged in courts, the chief justice observed, adding that a MNA himself had specific powers in this regard.
The bench, however, reserved the judgment on maintainability of the case.
