Filing Civil Miscellaneous Application (CMA) in the Supreme Court on Saturday, Jamaat-e-Islami (JI), one of the petitioners in Panama Leaks case, urged the court to form a commission to probe into the matter within specific time frame. JI Ameer Sirajul Haq filed the CMA through Advocate Asad Manzoor Butt seeking formation of an inquiry & trial commission in the matter.
Suggesting for constitution of the commission, Butt submitted that the commission would order Federal Investigation Agency and National Accountability Bureau and/or other authorities to investigate or inquire or study the available record papers and information available on the record.
It would also submit report about the legal position of the matter before the commission in specific period. Butt suggested that the commission order for forensic audit of all such record, papers documents, statements, tax returns and other available evidences and papers by a firm having good reputation and international standards. Butt said the commission shall constitute sub-commissions, as deemed necessary, for multidimensional requirements, consisting of serving judges of the high courts.
He further suggested that the commission shall have the powers of a court under the Constitution of Pakistan, existing civil and procedural law, contempt of court laws, Supreme Court Rules and other laws of the land, adding the commission shall exercise inherent power of the court to adjudicate the matter. Butt submitted that Ameer of the JI Sirajul Haq respected and had full confidence in the Supreme Court. He added that his client felt that the apex court might give decision regarding zero tolerance against corruption in the country.
