A divisional bench of IHC comprising Justice Aamer Farooq and Justice Miangul Hassan Aurengzeb announced the judgment that was earlier reserved after conclusion of arguments from both sides.
The federal government and four provinces moved to the IHC challenging the ECP notification dated April 11.
During the course of proceeding, the counsel for the petitioner contended that the ECP’s notification was an illegal move.
The ECP was authorized to issue such notification after announcement of election schedule, he said.
The counsel argued that the ECP was unauthorized to use powers of a government and its duty was to conduct free and fair elections.
He requested the court to declare the ECP’s notification as null and void.
After hearing the arguments from both sides at large, the court set-aside the notification of ECP.
