The prison authorities submitted a medical certificate, informing the judge that the then Malir SSP could not be presented owing to his deteriorating health. Directing the police to produce Rao Anwar in the next hearing, the judge ruled that the doctors who had made the medical report could be summoned if he was not presented.
Meanwhile, the investigators submitted a charge sheet (challan) with the ATC’s administrative judge according to which two persons were still absconding in the case.
The ATC’s administrative judge accepted the charge sheet and transferred the case to ATC-XIII for further proceedings.
Earlier, Rao Anwar had spent 30 days in police custody on physical remand after he was arrested form the Supreme Court premises.
Rao Anwar, DSP Qamar and several other cops have been nominated in the murder case of Naqeebullah who was gunned down in ‘staged encounter’ on Jan 14, 2018. The Chief Justice of Pakistan Mian Saqib Nisar had taken suo moto notice after the issue of extra judicial murder came to limelight.
The apex court had conducted several hearing at Islamabad and Karachi registry and had directivd the inspector general of police AD Khawaja to arrest Rao Anwar; however the Sindh police remained clueless about him.
The case was registered at Sachal police station under sections 302 (premeditated murder, 365 (Kidnapping or abducting with intent secretly and wrongfully to confine person), 344 (wrongful confinement for ten or more days), 109 (punishment of abetment if the Act abetted committed inconsequence and where no express provision is made for its punishment) and 34 (common intention of the Pakistan Penal Code read with Section 7 of the Anti-Terrorism Act, 1997.
