Absconders/POs: SHC orders Sindh govt to publish list in a month

KARACHI: Sindh High Court has ordered Sindh Home Department to publish complete list of absconders/proclaimed offenders within a month.

The SHC bench headed by Justice Salahuddin Panhwar also directed Inspector General Sindh to communicate the complete list of absconders/proclaimed offenders to the Home Department.

According a written order of bench released on Saturday, Mushtaq Ahmed Abbasi, Focal Person/DSP legal/Acting AIGP/Legal-1 presented complete detailed report along with mechanism for improving of Criminal Justice System, which was taken on record and undertook that names of all proclaimed offenders will be flashed at least in three newspapers of Sindhi, Urdu and English languages.

According to the focal person the publication is the domain of Home Department, Government of Sindh and such compliance report was called from the Home Department, Government of Sindh, which is awaited.

The court observed that the basic objective of Criminal Justice System is not limited to in getting the criminals punished but the prime object thereof is to prevent crimes which, in fact, requires adopting all measures first for preventing crimes; unearthing crime(s), if happened, and then to get the culprit punished from a competent court of law.

The court maintained that the use of modern devices such as CCTV camera(s), DNA testing etc, are the greatest examples by the world for preventing the crimes as well reaching to the criminals and stated that the importance of DNA has been reaffirmed in criminal cases, in particular rape / zina stood affirmed by apex court.

The court ordered that the draft of DNA law shall be sent to the Law Department, Government of Sindh through Secretary Law for perusal with further direction to submit repot whether any legislation is expected in this issue.

The court observed that to bring the absconders to light (before court of law) is also the unavoidable obligation of the State which, if requires publication of their names must not be delayed for want of approval by Home department.

Accordingly, I.G.P. Sindh shall communicate the complete list of absconders/proclaimed offenders to the Home Department and Home Department shall ensure publication within a month, court directed.

The court observed that no one can deny the importance of forensic sciences in Criminal Justice System because due to technological advancement, the criminals are also equipped with latest tools as well ideas for achieving their ill object, ie, 'committing crimes' thereby threatening the Criminal Justice System.

Therefore, need to improve areas of forensic sciences have become unavoidable, order stated and added that the Labs and experts are prepared so as to reach the crime and criminals within shortest period.
