The DG ISI submitted his affidavit through Col Fayaz explaining that the matter of missing person Arif was also pending before the Commission of Inquiry on Enforced Disappearances headed by the former senior most Judge of Supreme Court Justice Javed Iqbal.
A single member bench of IHC comprising Justice Riaz Ahmed Khan, resumed hearing of a plea of recovery of missing person Arif, filed by her wife Parveen Bibi.
During course of hearing, Additional Attorney General Shahid Khokhar also appeared before the court and said an FIR has also been registered in this case adding that investigation for recovery of missing person is underway.
After hearing the arguments, the court observed that the matter requires evidence and inquiry and this court can not enter into it.
However, the court asked the commission to expedite the inquiry in the matter of the missing person and disposed of the petition.
In earlier hearing, counsel for petitioner apprised the bench that Muhammad Arif and two others were picked up by ISI men a few months ago.
He alleged that other persons who were taken into custody along with Arif were released a few days later, while he was still in the agency's custody.
The Court had summoned DG ISI to appear before it with an affidavit pertaining to the custody of the missing person.
