ISLAMABAD: The Federal Board of Revenue (FBR) has imposed a major penalty of “Compulsory Retirement” on an Inspector-IR Directorate of Intelligence & Investigation (IR),Peshawar for concealing details of green leaf (raw tobacco) in the contravention report during raid on the premises of a beverage company.

In this regard, the FBR has issued a notification on Thursday.

According to the notification, whereas, disciplinary proceedings were initiated against Muhammad Ismail, Inspector-IR (BS-16), Directorate of Intelligence & Investigation (IR), Peshawar along with co-accused (a BS-19 Officer of IRS) vide Order of Inquiry, Charge Sheet and Statement of Allegations dated 26.09.2025.

Ms Uzma Munir, Commissioner-IR, RTO Islamabad, who was appointed as inquiry officer submitted inquiry report dated 30.12.2025 concluding that all charges levelled against the accused officer stand proved.

The Inquiry Officer recommended imposition of major penalty under rule 4(3) read with Rule 10(7) of the Civil Servants (Efficiency and Disciplinary) Rules, 2020 upon the accused.

The Chairman, FBR/ Secretary Revenue Division being Authority under Rule 2(1)(c) of Civil Servants (Efficiency and Disciplinary) Rules, 2020, granted an opportunity of personal hearing to Muhammad Ismail, Inspector (BS-17/Time Scale) on March 16, 2026. During the course of personal hearing, the accused IIR was asked as to why did he conceal/chose not to include details of presence of green leaf (raw tobacco) in the contravention report regarding his raid on the premises of M/s Sunslice Beverages.

The accused pleaded that he did not do so because green leaf is not a taxable/excisable item. He also pleaded that as per instructions of Directorate of Intelligence & Investigation (IR) seniors, he was not authorized to take action on tobacco related matters. It has been noted that even if he may not have initiated any action regarding taxability of raw tobacco, he should at least have mentioned it in the contravention report. The accused had no plausible answer to this regard.

After examining available record, inquiry report, reply of the accused officer and his verbal assertions, the Chairman, FBR/ Secretary Revenue Division being Authority in the case hasimposed major penalty of “Compulsory Retirement” upon Muhammad Ismail, Inspector-IR (BS17/Time Scale), Directorate of Intelligence & Investigation (IR), Peshawar under Rule 4(3)(c) of Civil Servants (Efficiency and Disciplinary) Rules, 2020.

He will have a right to appeal against this order to the Appellate Authority under Civil Servants (Appeal) Rules, 1977 within a period of 30 days from the date of communication of this Notification, FBR added.
