ISLAMABAD: Secretary Information PPP Chaudhry Qamamr Zaman Kaira assured participants here in a seminar to solve the issue of industrial relation laws before laps of Industrial Relations Ordinance 2008 expected to be expired on March 17.
The workshop titled `the Need for Federal Mandate on Industrial Relation Laws' was organized by Pakistan Institute for Legislative Development and Transparency (PILDAT).
He further assured that National Assembly session could be called for promulgation of such Law before its expiration.
It is pertinent to mention here that the President promulgated the Industrial Relations Ordinance-IRO 2011 and as with all Ordinances, the IRO-2011 was set to expire after 120 days on November 17, 2011.
It was however given one-time extension through a resolution of the National Assembly and it was now set to expire on March 17 of current year.
Dr. Farooq Sattar, Federal Minister for Overseas Pakistanis was the chief guest and other participants included MNA, Syed Sumsaam Ali Shah Bukhari, senior lawyer Babar Sattar, MNA Haider Abbas Rizvi, MNA, Riaz Fatiana, legal experts and representative of Labour Union Zahoor Awan.
Haider Abbas Rizvi said that 18th amendment is a very well thought out idea, it is nothing but devolution and it is a continuous process.
There should be a way that workers rights to be protected without harming provincial autonomy, he added.
Senior lawyer Babar Sattar, while giving the legal and constitutional aspect said that the state of Pakistan is under binding legal obligation to legislate the labour rights under various international treaties for which only the Parliament is authorized to legislate.
"Federal law is also needed for industries that fall within Federal areas, industries and unions that spread across two or more provinces, he added.
Riaz Fatiana said that federal government is responsible for international obligations so we cannot minimize the role of federal government in this regard.
Human rights are fundamental right which could not be federal or provincial, he said.
Syed Sumsam Ali Shah Bukhari believed that it is the credit of this Parliament that they reached on a consensus on 18th amendment.
"Flaws can be there in the amendment and it would have been better if there were an open debate on it in the Parliament but 99 per cent of the amendment has a very positive impact", he stated.
Fauzia Ejaz Khan, MNA, said that law should be made according to peoples need and it should be amended accordingly.
Zahoor Awan told that after abolition of concurrent list and approval of 18th amendment all provincial assemblies pass their own industrial relation act which only employ in their own territory.
He informed that there are 7204 trade unions in 5214 organizations in the country and except 370 organizations all other are registered under provincial laws
Earlier Executive Director PILDAT, Ahmed Bilal Mehboob said that 18th amendment is a milestone in our parliament history, as it had a big impact and improvement in the constitution but such a huge change could bring some problems with it as well.
